TERMS AND CONDITIONS

 

Thank you for booking Brian Shaw and/or acts managed by or represented by the Brian Shaw Entertainments Group* – Please take a moment to read through the terms below. Where mentioned, the “Artiste” is Brian Shaw or an act managed by or represented by the Brian Shaw Entertainments Group* and the “Booker” is the venue.

Acts that are or were part of, or represented by Brian Shaw or the Brian Shaw Entertainments Group include:

  • Brian Shaw (Actor)

  • Brian Shaw (Entertainer)

  • Brian Shaw (Vocalist)

  • Brian Shaw (Voice Actor)

  • Perfect Vintage (Duo)

  • Puttin’ on the Blitz! (Barbershop Quartet)

  • PD Entertainments

  • Perfect Dilemma

 

1. PAYMENT

 

1.1 Payment of the agreed fee can be made in advance or by cash on the day of the performance. Payment can also be made by cheque or BACS within 30 days of the performance date. Invoices can be sent in advance on request if that helps you to meet the payment terms.

 

On the occasion that payment is not made on time, the invoice total will be subject to a £40 late payment fee and Statutory Interest Rates.

 

If there is a breach of contract regarding the agreed payment terms, the artiste reserves the right to cancel the performance, and the invoice will be due subject to the 30 day terms unless an expenses agreement is made with the artiste at the time.

 

2. CANCELLATION

 

 This applies to all bookings except “Seasonal” and “Specialist” shows (see 2.2 for details).

 

2.1 Notice of a cancellation must be given at least 7 days before the performance date. Verbal bookings will be followed up in writing. Non-reply of this confirmation does not constitute a cancellation.

Cancellation made with less than 7 days notice will requite the invoice amount to be paid in full. Exceptional circumstances such as force majeure, death or sickness in the venue may waiver the invoice charge, but this is at the artiste’s discretion. If circumstances require a cancellation, then at the artiste's discretion and subject to availability, the option of a rebooking may be available provided the rebooked performance is completed within 30 days of the original booking. The booker may also be liable to pay the artiste additional travel expenses for a second booking or travel expenses for the first booking if the cancellation occurs once the artiste has already started their journey to the venue.

These cancellation terms also include the event of a double booking and booking errors made by the booker. i.e. wrong date or time etc.

If the artiste needs to cancel. We endeavour to provide as much notice as possible, reschedule where appropriate and/or find a replacement artiste or group where necessary. If we are unable to reschedule or find a replacement, then any payment made in advance will be fully reimbursed.

2.2 Seasonal and specialist shows.

These types of bookings are very popular and usually taken up to a year in advance and therefore other potential bookings are turned away as these bookings are held for several months or more for the booker and other bookings cannot be taken. These bookings may also involve complex planning, excessive travelling and occasional booking of accommodation and therefore different cancellation rules apply.

Seasonal and specialist shows include:

  • Christmas Shows

  • New Year Shows

  • St George’s Day

  • Remembrance Day

  • VE Day

  • Exceptional events (i.e Queen's Jubilee)

  • Weekend bookings such as air shows and county fairs

Once the original booking is made you have up to 14 days to cancel. After 14 days from booking, all seasonal and specialist bookings become non-cancellable under any circumstances and payment will be due regardless. Any deviation from this would be at discretion of the artist, such as the option to rebook another performance provided it was completed within 30 days of the original booking (see 2.1).

If the artiste needs to cancel. We endeavour to provide as much notice as possible, reschedule where appropriate and/or find a replacement artiste where necessary. If we are unable to reschedule or find a replacement, then any payment made in advance will be fully reimbursed.

2.3 Coronavirus (COVID-19).

If for any reason the performance is not allowed to continue in the home due to any current government restrictions or illness, then you will be offered a performance where the artiste/s will perform outside the home instead. If further restrictions prevent this from happening, then you will be offered an online interactive performance in place of the original booking (All performances are the same price). You are welcome to choose an online performance instead of an outdoor performance regardless of restrictions if you feel this would suit your situation better.

 

If you cannot or do not want an outside performance and refuse to or are unable to accept the online performance, then normal cancellation policy will apply (see 2.1).

3. VOICEOVER

The Artiste will provide a voiceover in a timely manner and in the appropriate format as agreed prior to the recording. The Artiste will provide one change to the original recording if any pick ups are needed, or one re-record. A second change or re-record may be provided at the Artiste's discretion if it is a minor change. The Artiste will work with the booker constantly to ensure they have the sound they want, but can not continue to make multiple changes in perpetuity. So only one change or re-record will be provided (two at the artistes discretion). If further changes are needed then the booker will be charged the standard fee as if it were a new booking.

4. INSURANCE:

The Artiste will provide Public Liability Insurance up to the value of £10,000,000 for all acts except Puttin’ on the Blitz! Where the Public Liability Insurance is for £5,000,000.

5. DAMAGES

The client assumes liability and cost if equipment owned by the artiste is damaged by the client and/or guests. The artist reserves the right to deny anyone access to property owned by our company.

6. LEGALITIES

The artiste and/or all agents are released from any damages/litigation due to client, guests and any other personnel or properties.

7. EQUIPMENT

The artiste will provide all necessary equipment to put on a show unless it is agreed that the artiste will be using equipment provided by the venue. The venue must provide an electrical outlet if the artiste is using their own equipment.

8. MISCELLANEOUS:

The artiste will be paid for any parking costs (if applicable) at the venue on the day of the event and will be reimbursed by the client. If any proportion of the event is outside during the day, the client or venue will supply some form of shade (tent, gazebo). The artiste/s will require an electrical outlet. Gratuities are made at the sole discretion of the client.

Additional charges may apply for excessive moving of equipment from the originally designated set up area or for difficult load-in due to stairs, lifts and/or long distances between loading and party areas. Also for any issues that may result in the artiste having to attend the venue earlier than they would normally expect to.

9. OTHER

On occasion, Brian Shaw or acts that are managed or represented by Brian Shaw or the Brian Shaw Entertainments Group may be replaced with another artiste or group of similar experience and ability.

10. CHANGES TO THIS POLICY

 

Brian Shaw and acts managed or represented by the Brian Shaw Entertainments Group reserves the right to change these terms & conditions at any time. We will let you know at the bottom of this page the date it was last updated.
